The Panel was requested to determine whether or not to permit a variation to the premises licence for the premises known as the Slug and Lettuce, 10 Derby Square, Epsom, Surrey KT19 8AG.

Five representations objecting to the application on the grounds of public nuisance had been received.  No representations had been made by responsible authorities.  However, the Local Planning Authority stated that planning permission for these premises as set out under 06/01091/FUL was to restrict the hours of opening to 0800 to midnight on Fridays and Saturdays and 0800 to 0200 on Christmas Eve and New Year’s Eve.

Solicitors acting on behalf of the applicants provided the Panel with a verbal submission in support of evidence circulated to Panel members on 20 April.  An informal meeting had been held with Ward councillors and attempts had been made to engage with those who had made representations.  The Panel, the three Town Ward councillors and a resident of Oaks Square who had made representations on the application asked the solicitors acting on behalf of the applicant and representatives of the premises a number of questions.

Ward Councillors Tony Axelrod (also a resident of Hudson House) and Tella Wormington and local resident Ms. Truslove provided the Panel with a verbal summary of their representations. This included information relating to crime and disorder in the town centre and public noise nuisance experienced by residents of Oaks Square and Hudson House Station Approach, Epsom. Councillor Neil Dallen verbally provided the Panel with a list of suggested amendments/additions to the proposed conditions of the licence designed to abate noise nuisance and address concerns around public nuisance.

Following these representations, the Panel provided the solicitors on behalf of the applicant the opportunity to provide a closing summary of their representations.

Following consideration of the written and verbal representations made, the Panel RESOLVED that the Premises Licence should be varied as follows:

To remove all conditions at Annex 2 on the premises licence and to replace these with an updated operating schedule as detailed in the application submitted to the licensing authority:

Hours premises are open to the public

To extend the start time for opening hours and films to start from 07:00 Monday to Sunday (including standard and non-standard timings as set out in the application) to allow for breakfast opening.

Terminal Hour

To extend the terminal hour for opening times to 01:30 the following day on Fridays and Saturdays

Provision of regulated entertainment

To extend the terminal hour for regulated entertainment in the form of films, indoor sporting events, live music, recorded music, performance of dance to 01.00 the following day on Fridays and Saturdays

To add non-standard timings for notable days as detailed in the application submitted to the Licensing Authority

Provision of late night refreshment

To extend the terminal hour for the provision of late night refreshment to 01.00 the following day on Fridays and Saturdays

Sale by retail of alcohol
