Private Hire Driver's Licence

This information has not been published on the grounds that it relates to information relating to an individual and which is likely to reveal the identity of an individual, and the public interest in maintaining the exemption currently outweighs the public interest in disclosing the information.

 

Minutes:

The Panel was asked to determine whether a Private Hire Driver’s License should continue, be suspended or be revoked, following the Council being informed that the license holder had received a conviction for driving without due care and attention in August 2015.

The Licensing Officer informed the Panel that it was a requirement of the Local Government (Miscellaneous Provisions) Act 1976 that the Authority be informed within 7 days of any conviction during the period of a Private Hire Driver Licence. The Panel was informed that the applicant had been convicted of an offense in August 2015, but the Council had not been informed of it until September 2016, when the applicant submitted an application for a renewal.

The applicant and the witness addressed the Panel. The applicant and witness informed the Panel that the Licensing Authority had not been informed of the conviction at its time of occurrence due to an error by the applicant, but that there had not been any attempt to hide it. The applicant and witness also informed the Panel that the conviction had been fully disclosed in the applicant’s application for a licence renewal. The Panel asked questions to the applicant.

Following consideration, the Panel RESOLVED:

(1)          That the applicant’s Private Hire Driver’s Licence should continue.

The Panel reminded the applicant of the requirements of holding a Private Hire Driver’s Licence, and stressed the importance of meeting them.
