The Panel was requested to determine an application for a Premises Licence for Sanchos Grill, 67 Poole Road, Epsom, Surrey, KT19 9SQ made under the Licensing Act 2003.

One objection to the application had been received from a local resident on the grounds of public nuisance, prevention of crime and disorder and the promotion of public safety. One objection had been received from the Environmental Health Service, in response to which the applicant had subsequently agreed additional conditions.

A verbal representation was received by the Panel from the applicant. The applicant set out the reasons for the application. Following questions from the Panel, the applicant informed the hearing that delivery drivers would park their vehicles in Gadesden Road for deliveries after 11pm, and only telephone and internet orders would be accepted from 11pm. Customers would not be served directly from the premises after 11pm.

A verbal representation was also received by the Panel from the objector. This supported their written representation, informing the Panel that properties neighbouring the premises were residential in nature and expressing a concern that extending the hours of the premises would lead to an increase in noise nuisance to residents. The objector also expressed concern that the site notice advertising the application had not been properly displayed. The Chairman informed the hearing that legal advice had been taken with regard to this matter, and the Panel considered that the advertisement complied with the legal requirements. 

Following consideration of the written and verbal representations made, the panel RESOLVED that:

The Licence should be granted with the following conditions:

(1)          Monday to Saturday – close the business front door at 11:00pm and operate the kitchen for online or telephone sales by delivery only (no collect in person), till 12:30am.

(2)          Sunday - close the business at 11:00pm, with no online /telephone sales or deliveries.

(3)          Delivery drivers having vehicles being used for deliveries which are under the control of the premises shall turn off the vehicle whilst not in use.

(4)          The Premises Licence Holder shall manage delivery drivers to ensure their conduct at the premises does not cause a public nuisance to the occupiers of any residential properties surrounding the premises address.

(5)          Delivery drivers are to use the rear door to the premises to take deliveries out to the delivery vehicle.

(6)          The premises will close at 11:00pm with the front door being locked and the internal front waiting area lights turned off.

(7)          The Premises Licence Holder shall ensure that the ventilation extract ducting does not cause noise or odour nuisance to the area by taking any measures needed to minimise noise and odour.
