The Licensing (Hearing) Sub-Committee is asked to determine a variation application made under the Licensing Act 2003.

The Sub-Committee was requested to determine a variation application made for Minature, 11-13 Upper High Street, Epsom under the Licensing Act 2003.

One representation had been received from a local resident with regard to the application, which had been provided to the Sub-Committee within the agenda papers for the meeting. This resident did not wish to make a verbal submission to the meeting. Two objections were received, from Surrey Police and Environmental Health.

A verbal representation was received by the Sub-Committee from the Applicant and their representative. The representation outlined the nature of the premises and the actions taken by the Applicant to address the concerns raised in the representations received.

The Applicant responded to the questions from the Sub-Committee and confirmed the following:

a)            CCTV: The Applicant informed the Sub-Committee that they had installed 16 operating CCTV cameras managed by themselves and the Door Supervisor. The Committee noted the Applicant’s representation that it would comply with reasonable requests from relevant authorities regarding the location and use of those cameras.

The Sub-Committee retired, with the legal representative, to consider the application further and then the meeting reconvened in public. The Chair announced the decision of the Sub-Committee which is detailed below.

Following consideration of the material presented in the agenda, the written and verbal representations made, and having had regard to the Statutory Guidance and the Licensing Policy of the Council, the Sub-Committee resolved to:

Grant the Application (subject to relevant mandatory conditions and modified with the conditions set out below) to vary the Premises Licence for the above address for the following standard days and times:

In the outdoor area (i.e., The Mono Bar):

7 days per week

Alcohol and recorded music only from 11.00 hours until 23.00 hours with the outdoor area closing at 23.30 hours.

 

As before, those times are extended on New Year’s Eve, Valentine’s Day and Persian New Year (20-23 March) until 1am with the Mono Lounge to be closed at 1.30am.

In the indoor areas (i.e., Miniature Restaurant and Basement Bar):

Sunday-Wednesday

Licensed hours will remain as before in relation to alcohol and music (both recorded and live music) which are as follows:

From 11.00 hours until 23.00 hours with the restaurant and basement bar to close at 23.30 hours.

Thursday-Saturday

Licensed hours in relation to alcohol and music both recorded and live which are now as follows: From 11.00 hours until 00.30 hours with the Miniature Restaurant and Basement Bar area closing at 01.00 hours.

The seasonal or non-standard timings for the restaurant and basement bar on New Year’s Eve, Valentine’s Day, Persian New Year (20-23 March) and Christmas Eve will be 01.30am for the sale of alcohol, live music and recorded music. Closing at 02.00am.

As well as any applicable mandatory conditions licence activities will be subject to the following Conditions:

(1)          A condition to comply with the operating schedule as submitted as part of a variation application.
